The Payment of Wages Act, 1936 protects covered workers by regulating how and when wages must be paid, restricting wage deductions, and providing a process to claim delayed or unlawfully deducted wages.
Key protections include:
- Employers—including contractors—are responsible for paying wages required under the Act.
- Wage periods and payment times are regulated.
- Wages must be paid in current coin or currency notes.
- Deductions are limited and regulated, including deductions for absence, damage or loss, services, advances, cooperative societies, and insurance schemes.
- Workers may bring claims concerning delayed wages or improper deductions before the authority under section 15.
- An unpaid group may submit a single application.
- The Act provides for appeals, inspectors, recovery from employers, and penalties for offences.
- Under the Lahore High Court’s decision in M/s Askari Guards (Pvt) Ltd. v. Authority under Payment of Wages Act, a wage-recovery complaint is maintainable before the Act’s Authority even if the employer is a trans-provincial entity.
The Act applies to wage payments for persons employed in factories, industrial or commercial establishments, and specified railway employment.

Yes. Article 17(1) of Pakistan’s Constitution gives every citizen the right to form associations or unions, subject to reasonable restrictions imposed by law in the interests of Pakistan’s sovereignty or integrity, public order, or morality.
The Industrial Relations Act, 2012 specifically regulates the formation of trade unions in the Islamabad Capital Territory and in trans-provincial establishments and industries.

Is zakat deducted automatically from bank accounts, and under what law?

Yes. Under Pakistan’s Zakat and Ushr Ordinance, 1980, Zakat is compulsorily deducted at source from savings bank accounts and similar accounts maintained with banks, post offices, National Savings Centres, and relevant financial institutions.
The deduction is 2.5% of the account balance at the start of the Valuation Date, on the deduction date notified for that Zakat year. No deduction is made where the balance does not exceed the exemption amount notified by the Administrator-General.

What remedies does the workplace harassment law give an employee in Pakistan?

Under Pakistan’s Protection Against Harassment of Women at the Workplace Act, 2010, an employee may:
- Make a harassment complaint, which can be dealt with through the organization’s mandatory Inquiry Committee and designated Competent Authority.
- Approach the Ombudsperson, who may investigate the complaint and impose any prescribed minor or major penalty.
- Use the Act’s stated appeal and representation mechanisms, including representation to the President or Governor, where applicable.
- Petition the District Court if the employer fails to implement the Act—for example, by not forming an Inquiry Committee, designating a Competent Authority, incorporating the Code of Conduct into policy, or displaying it at the workplace. A non-compliant employer may be fined between Rs.25,000 and Rs.100,000.
The law also covers harassment in situations linked to official work or activities outside the physical office, including unwelcome sexual conduct, verbal or written communications, and abuse of authority.
